Francisco Costa Cabral comments on the Commission’s initiative to revise the Notice on the Definition of the Relevant Market

The Commission has requested feedback on its initiative to revise the Notice on the Definition of the Relevant Market (see here). Among the several comments received (see here), CVA’s of-counsel Francisco Costa-Cabral suggested reconsidering the competitive constraints caught by market definition, so that static concerns are de-emphasised in competitive analysis and the Notice is aligned with the broad notion of substitutability in the case law (comments available here).
